PARTICULAR BOOKING TERMS AND CONDITIONS

1. GENERAL

The purpose of this document is to regulate the General Terms and Conditions for Contracting the hotel and non-hotel stay booking services:

The Website only provides information about hotel and non-hotel vacancies at the time of requesting such information. Therefore, when booking online, you are directly establishing a contract with the tourist accommodation and not with the Website.

The use of the Website and the contracting of services (hereinafter the 'Services') offered therein, implies, on the part of its users and/or guests (hereinafter, both referred to indistinctly as 'User' or 'Users') full and unreserved acceptance of each and every general terms and conditions that are set out below, as well as their validity, (hereinafter the 'Terms and Conditions') (which shall be considered automatically incorporated in the contract which, if applicable, shall be signed with THe Hoteles, without the need of including their transcription in the contract) and, therefore, it is important that Users read the Terms and Conditions each time they visit the Website, as well as all those specific of each Service, which shall also be accepted.

TOTAL HOTEL EXPERIENCE reserves the right to change, modify, add or remove any part of the Terms and Conditions at any time and to modify the Services without prior notice.

In order to access the services of the Website and, if applicable, to contract the services, the User declares that they are of legal age and have the legal capacity to act in accordance with their national law.

In case of contracting third-party products offered through the Website, the general terms and conditions of the third-party shall apply. The User is hereby reminded about the importance of printing or downloading these terms and conditions, and reading them in detail.

2. BOOKING PROCEDURE

  • Once the User accesses the Website, in order to proceed with the booking of the Services, they shall follow all the indications and instructions contained in the purchase procedure, filling in the Particular Terms and Conditions and other forms established for each Service, which shall imply the reading and acceptance of all the applicable General and Particular Terms and Conditions.
  • By checking the acceptance of the Terms and Conditions, the User ratifies the contract with THe Hoteles, confirming the dates indicated in the booking, the tourist accommodation chosen, the number of rooms and persons and any other Particular Terms and Conditions of the Service detailed in the purchase procedure. The User undertakes to confirm the truthfulness and accuracy of the information provided, being void any booking in which the User has provided false information. No tourist accommodation shall accept vouchers or booking confirmation documents resulting from false information. In those cases in which the User has made a booking with false information, the User shall be liable for the processing and operational costs generated by the booking and shall compensate the tourist accommodation for the loss of profit derived from the reservation of rooms that shall not be finally booked by the User, nor by third parties.
  • After formalising the booking, the guest is required to review the content of the booking in order to identify any possible material errors when entering the data. In the event that the guest should find any type of error, they can contact THe Hoteles by telephone or e-mail, providing the identifying data of the booking.
  • The electronic booking process shall be complete, meaning that the booking service has been contracted:
    1. If payment for the contracted service is made at the tourist accommodation: With the reception of the confirmatory email.
    2. If payment for the contracted service is made online: As soon as the positive charge is made to the credit card provided by the guest.
  • Payment methods: THe Hoteles makes available to its guests different means of payment accepted for the booking of services.
    1. Payment of the contracted service at the tourist accommodation: In this case, the data provided by the guest, in relation to the credit card, shall be used as a guarantee, without any charge being made on it for the contracted services. The payment of the room and/or contracted services shall be made by the guest at the tourist accommodation, at the time of check-in or arrival.
    2. Online payment of the contracted service: This payment method involves the automatic charging of the amount corresponding to the room/s and/or services booked to the credit card whose details have been provided by the guest beforehand. Consequently, the choice of the online payment implies the provision of consent both for booking the room and/or contracted service and for the corresponding payment.
  • The booking shall be confirmed through the Website itself by means of a booking code, and a screen with detailed information will be shown.
  • Likewise, once the corresponding charge has been made for the booking, THe Hoteles shall send the User a final confirmation e-mail in relation to the booking, indicating each of the particular terms and conditions of the booked/contracted service.
  • The Terms and price of the booked reservation are expressly specified in the purchase procedure.
  • After booking, THe Hoteles will send the User an e-mail containing receipts and/or documents applicable to the specific booking.
  • The documents containing contractual commitments between the parties are, in the following order of priority, the booking voucher or request (including the particular terms of the fare booked) and these Terms. In case of contradiction between the booking voucher and the Terms, the provisions of the booking voucher shall prevail for the obligation in dispute.

3.- BOOKINGS, CANCELLATIONS AND CUSTOMER CARE

The User may cancel the booking through the Website or call centre. To modify a booking, they shall contact the Call Centre. The modification, cancellation or no-show booking terms shall be stated in the purchase process specified on the Web. The User must know and accept them expressly when making the reservation. In the event of a change or cancellation involving costs, these shall be charged directly to the credit card that was provided as a guarantee upon the purchase.

The following shall be understood as a modification:

  • Changing the entry date
  • Shortening the initially booked reservation
  • Modifying the number of rooms booked when the reservation is within the cancellation period specified on the Web.

The modification of the User name with which the booking was made shall be deemed as a cancellation.

4.- NO SHOW

If the guest does not show up at the tourist accommodation on the entry date and has not cancelled the booking, it shall be deemed as a 'no-show'. In case of a no-show, if the reservation was paid by credit card, The Hoteles shall charge the fee indicated in the cancellation policy provided upon booking. The amount shall be charged to the credit card that the guest provided to guarantee the reservation. Cancellation policies may vary according to the market and dates and are always provided in the terms and conditions of sale of the rate booked. In the event of choosing a non-refundable rate during the reservation, the penalty shall consist of paying 100% of the total stay amount. THe Hoteles shall notify the no-show charge by e-mail, sending a 'Proof of Cancellation' document.

5.- PRINCIPLE OF CONSERVATION

If one or more clauses included in the Terms are deemed totally or partially null and void, only such provision or part thereof, as appropriate, shall be not valid. Other Terms shall remain valid, and such provision or part thereof shall be deemed not in force.

6.- NOTIFICATIONS

All notices, demands, requests and communications by the parties regarding the Terms shall be made in writing and shall be deemed as duly made when delivered by hand or sent by regular mail or e-mail to the other party's address.

7.- APPLICABLE LAW AND COMPETENT JURISDICTION

Any dispute arising from the use of the Website shall be governed by the Spanish Law and the Courts and Tribunals of Las Palmas de Gran Canaria (Las Palmas-Spain). This is the complete and comprehensive agreement between The Hoteles and the User, superseding all previous pacts, commitments, representations or agreements, whether written or verbal, that may have previously been made between them. In any case, any dispute that may arise from the service provision shall be submitted to the Courts and Tribunals of the consumer's domicile.
